1. These terms

These terms apply to every order placed through the checkout on www.zulu-ltd.com, and to every quotation we issue and order we confirm after an enquiry made through it. They also apply to subscriptions to our software applications, which are taken out and billed within the application concerned. When you place an order or accept a quotation you agree to these terms, so please read them first.

2. What we sell

General merchandise and trade supplies, together with subscriptions to our software applications. Goods are sourced mainly from suppliers in China and shipped to you by international air freight and courier. Every ZX product (a product whose code begins with ZX, marked Special Order in our catalogue) is a special order, placed with the supplier once you pay. Product descriptions, images and specifications are provided in good faith. Where a specification matters to you, ask us to confirm it in writing before you place your order or accept a quotation.

3. Orders and acceptance

Placing an order at checkout, or accepting a quotation, is an offer to buy. A contract is formed when your payment is received; payment confirms the order, and we send you an order confirmation by email. If we cannot supply an item we will tell you promptly and refund any payment taken for it.

4. Prices and payment

• Prices are set in Papua New Guinea kina (PGK). If you visit from Fiji, Solomon Islands, Vanuatu, Samoa, Tonga or the Cook Islands, you may see prices in your local currency for reference: Fiji dollars (FJD), Solomon Islands dollars (SBD), Vanuatu vatu (VUV), Samoan tala (WST), Tongan paʻanga (TOP), or New Zealand dollars (NZD) in the Cook Islands, converted from the kina price. Online checkout currently delivers only to addresses in Papua New Guinea, and orders are normally charged in kina. The amount shown at checkout, in the currency shown there, is the amount charged to your card.
• The price shown for a product is for the goods; international air freight to Papua New Guinea is added as its own line at checkout, before you pay. Items that are not listed, and large or mixed orders, are quoted in writing, in the currency stated on the quotation.
• Orders placed at checkout are paid in full by card at checkout. Payment terms for a quotation are stated on it, and a quotation may also be paid by card online. Card payments are processed by Stripe on behalf of Zulu Express LLC; we never see or store your full card number.
• Your card issuer may add its own fee for a payment to an overseas business or in another currency; that fee is set by your bank, not by us.
• Subscriptions to our software applications are billed within the application concerned by its own billing provider (HariApp bills through Paddle), not by card through this website, on the terms shown when you subscribe; see our Subscriptions & Cancellation policy.
• If a price on the website or on a quotation is obviously wrong, we will contact you before the order goes ahead and refund any payment taken, rather than hold either of us to the incorrect figure.

5. Delivery

Delivery timeframes, costs and risk are set out in our Shipping & Delivery policy, which forms part of these terms. Estimated delivery for each item is shown on its product page, counted from the day we place your order with the supplier; this is an estimate, not a guarantee. Import duty, taxes and courier handling charges are paid by you to the courier before it releases the goods to you, and are not included in the price you pay us, at checkout or on a quotation.

6. Returns, refunds and cancellation

Your rights to return goods and obtain a refund are set out in our Returns & Refunds policy. Cancelling a goods order before despatch, and subscription cancellation, are covered by our Subscriptions & Cancellation policy. Both form part of these terms.

7. Subscriptions

Software subscriptions renew automatically for successive periods until cancelled. You may cancel at any time; cancellation takes effect at the end of the period you have already paid for, and you keep access until then.

8. Acceptable use

Do not use this website to break the law, infringe anyone's rights, or interfere with its operation or security. We may suspend access where we reasonably believe this has happened.

9. Our liability

We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. Subject to that, our total liability for any order is limited to the amount you paid for it, and we are not liable for indirect or consequential loss, including loss of profit or of business opportunity.

10. Events outside our control

We are not liable for delay or failure caused by events beyond our reasonable control, including natural disaster, civil disturbance, port or customs disruption, carrier failure, or the interruption of shipping or air services from the supplier's country or to and within Papua New Guinea and the Pacific.

11. Governing law

These terms are governed by the laws of the State of Wyoming, United States, and the courts of that state have jurisdiction. Nothing here removes any right you have under the mandatory consumer law of the country you live in.

12. Changes

We may update these terms. The version in force when you place your order or accept a quotation is the one that applies to that order. The effective date is shown at the top of this page.
